Laws & Regulations
Properties operated as holiday lets typically need planning permission for change of use from residential (C3) to commercial short-term letting, and tourist destinations like Cornwall may impose local restrictions on second home ownership or holiday lets. Designated areas such as National Parks, Areas of Outstanding Natural Beauty and Conservation Areas can face additional planning restrictions. Please seek professional guidance on the law and finances where needed.
Holiday lets need annual gas safety inspections by Gas Safe registered engineers, regular electrical safety checks, and working smoke alarms, carbon monoxide detectors, fire risk assessments and clear evacuation routes. Soft furnishings must meet fire-resistant standards. We can arrange all of these checks for you. Please seek professional guidance on the law and finances where needed.
Holiday lets meeting specific criteria are classified as businesses rather than investments for tax purposes. Properties available at least 140 days per year face business rates instead of council tax. Operators need public liability insurance and must comply with data protection laws (UK GDPR) when handling guest data. Please seek professional guidance on the law and finances where needed.
Mortgage requirements for holiday letting properties differ from residential mortgages, and VAT registration is required if turnover exceeds the current threshold. Tax treatment, including Furnished Holiday Letting status and Capital Gains Tax reliefs, has its own rules. Please seek professional guidance on the law and finances where needed.
Some local authorities require registration or licensing of holiday accommodation, and some restrict the number of days a property can be let without planning permission. Requirements vary by area, so check with the local authority for your property. Please seek professional guidance on the law and finances where needed.
