Relevant laws and regulations

Holiday home ownership in the UK is subject to several important laws and regulations that property owners need to navigate carefully. Here are the key things you need to know but please seek professional guidance on the law and finances where needed.

    • Properties used as holiday lets typically require planning permission for change of use from residential (C3) to commercial short-term letting.

    • Some areas, particularly tourist hotspots like Cornwall, may have local restrictions on second home ownership or holiday lets.

    • In designated areas like National Parks, Areas of Outstanding Natural Beauty, or Conservation Areas, additional planning restrictions may apply.

    • Gas Safety (Installation and Use) Regulations require annual gas safety inspections by Gas Safe registered engineers.

    • Electrical Equipment (Safety) Regulations and Electrical Safety Standards mandate regular electrical safety checks.

    • Fire Safety Regulations require working smoke alarms, carbon monoxide detectors, fire risk assessments, and clear evacuation routes.

    • Furniture and Furnishings (Fire Safety) Regulations specify fire-resistant standards for all soft furnishings.

    • Holiday lets meeting specific criteria are classified as businesses rather than investments for tax purposes.

    • Business rates rather than council tax apply if the property is available for letting at least 140 days per year.

    • Public liability insurance is essential to protect against guest injury claims.

    • Data protection laws (UK GDPR) apply when collecting and storing guest information.

    • Specific mortgage requirements for holiday letting properties differ from residential mortgages.

    • Furnished Holiday Letting (FHL) status offers certain tax advantages but requires meeting minimum letting periods.

    • Capital Gains Tax relief may be available through Business Asset Disposal Relief (formerly Entrepreneurs' Relief).

    • VAT registration is required if turnover exceeds the current threshold (check rates).

    • Some local authorities require registration or licensing of holiday accommodation.

    • In certain areas, there may be restrictions on the number of days a property can be let without requiring planning permission.
